Agreement regarding the Status of Personnel of Sending States attached to an International Military Headquarters of NATO in the Federal Republic of Germany

Preambule

The Kingdom of Belgium,

Canada,

the Federal Republic of Germany,

the Kingdom of the Netherlands,

the United Kingdom of Great Britain and Northern Ireland, and

the United States of America

Have agreed as follows:

Article 1

1.

In this Agreement the expression

  1. (a)

    “NATO Status of Forces Agreement” means the Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces, signed in London on 19 June 1951;

  2. (b)

    “Supplementary Agreement” means the Agreement to Supplement the Agreement between the Parties to the North Atlantic Treaty regarding the Status of their Forces with respect to Foreign Forces stationed in the Federal Republic of Germany, and the Protocol of Signature, signed in Bonn on 3 August 1959;

  3. (c)

    “Protocol” means the Protocol on the Status of International Military Headquarters set up pursuant to the North Atlantic Treaty, signed in Paris on 28 August 1952;

  4. (d)

    “Headquarters” means any international military Headquarters of NATO established in the Federal Republic of Germany pursuant to the North Atlantic Treaty;

  5. (e)

    “sending State” means one of the contracting Parties to the sent Agreement, with the exception of the Federal Republic of Germany.

In this Agreement, except in so far as reference is made in Articles 2 and 3 to expressions used in the NATO Status of Forces Agreement and the Supplementary Agreement the expression

  1. (a)

    “force” means the personnel belonging to the land, sea or air armed forces of a sending State;

  2. (b)

    “civilian component” means the civilian personnel who are in the employ of the land, sea or air armed forces of a sending State, and who are not stateless persons, nor nationals of any State which is not a Party to the North Atlantic Treaty, nor German nationals, nor ordinarily resident in the Federal Republic of Germany;

  3. (c)

    “dependents” means

    1. (i)

      the spouse of a member of a force or of a civilian component, or a child of such member depending on him or her for support;

    2. (ii)

      a close relative of a member of a force or of a civilian component, not falling within the definition contained in item (i) of this sub-paragraph, who is financially or for reasons of health dependent on, and is supported by such member, who shares the quarters occupied by such member, and who is present in the Federal territory with the consent of the authorities of the force;

    3. (iii)

      the persons mentioned in items (i) and (ii) of this subparagraph, upon the conditions set out in sub-paragraph (b) of paragraph 2 of Article 2 of the Supplementary Agreement, for a period of ninety days after the death or the transfer of the member of a force or of a civilian component.
