Partijen worden hierna de Stichting en Vattenfall genoemd.
1 De procedure
Het verdere verloop van de procedure blijkt uit:
- het tussenvonnis van 1 februari 2023,
- de rolbeslissing van 1 maart 2023, - de akte van de Stichting van 15 maart 2023, met producties, en de (enkel aan de rechtbank toegezonden) akte op grond van artikel 22 lid 6 Rv van de Stichting, - de antwoordakte van Vattenfall van 12 april 2023 met producties,
- de akte uitlating producties van de Stichting van 26 april 2023
- uit rechtsoverweging 2.24 zal blijken dat de procedure onder het oude collectieve actierecht zaaknummer C/13/739929 HA ZA 23-873 krijgt.
Ten slotte is opnieuw vonnis bepaald.
2 De verdere beoordeling
In de ‘Litigation Funding Agreement’ van 4 augustus 2021 (hierna: de financieringsovereenkomst) die is gesloten tussen de Stichting en de procesfinancier Bench Walk Guernsey PCC LTD (hierna: de procesfinancier) staat onder meer:

3. Proceeds
The Funder is entitled to receive the Total Fee, which it must apply to pay
itself, ClaimShare and the Lawyer in accordance with the Waterfall.
(...)
4 Additional Funding
If funding is likely to be required in connection with the Claim in excess of the Budget:
(a) the Class Representative [de Stichting] shall notify the Funder promptly; and
(b) the Funder may (...) give written notice that it will provide
additional funding to meet those additional costs and the terms on which it proposes to provide that additional funding (...)
