This article describes how the municipality of ‘s-Hertogenbosch implemented elements of the Performance Information Procurement System (PIPS)procedure in a recent procurement procedure. The article draws conclusions on the compliance of these elements,in the form adopted in the current procedure, with the ARW 2005. Finally, the article argues that the national restricted procurement with pre-selection prescribed by the ARW 2005 is too strict for the efficient application of the elements of the American methodology. Based on the results of this pilot project, the municipality may need to choose a more flexible policy for the works contracts which can benefit from the application of the American methodology.

De wetgever heeft ter zake van de implementatie van de Rechtsbeschermingsrichtlijn geen maatregelen getroffen. Dit betekent dat rechtsvragen betreffende de rechtsbescherming van gegadigden bij aanbestedingen moeten worden beantwoord aan de hand van het bestaande Nederlandse recht. Daarbij is de rechter overigens wel gehouden het nationale recht zoveel mogelijk in het licht van de bewoordingen en het doel van de Rechtsbeschermingsrichtlijn uit te leggen, of te wel richtlijnconform te interpreteren.

Eind juni 2009 heeft de Minister van Volkshuisvesting, Ruimtelijke Ordening en Milieubeheer een voortgangsrapportage duurzaam inkopen aan de Tweede Kamer gezonden.
